Guys:
just talked to an IO at Nebraska and was told that my file is waiting for an officer to look at.
When I asked how long will it be before they get to it, she says they have like 500 cases each but that I should be hearing something soon?
Any ideas ...how soon ? Has anyone else had a similar conversation and how long did it take before they heard something??
I know there is nothing definate...but just wanting to share and hear back if anyone had similar experience.

The Senate approved a stop-gap spending bill that will allow the Department of Homeland Security to operate until the end of October while House and Senate conferees try to work out a final version of the agency's spending bill. As of November 20, 2009, 56,900 H-1B cap subject nonimmigrant visa petitions have been filed with the USCIS. The Service has advised that they will continue to accept petitions until the cap is reached.
Qualifying applicants are still able to petition for an H-1B nonimmigrant visa (http://www.mvplawgroup.com/workvisas.php?action=h1bvisa) under the general cap.

My I-485 and I-140 was filed last week. I was wondering how many days it takes to get receit and .
when does the six month count down for AC21 begin???? Is it after receit date or fedex date..thnx

You need to wait till your I-140 is approved. Otherwise, you will face problem in AC21 stage.
That said, the 180 days count from "receipt" date in your I-797 (receipt for I-485). And its better to have few days more, if not few weeks/months (just to be safe).

H-1B visas are a relatively swift path to employment for foreigners with bachelor's degrees and U.S. employers to sponsor them. Each year, the U.S. government makes 65,000 H-1B visas available to qualified individuals on a first-come basis. The cap has been reached every year for the last several years, and for fiscal year 2008, it was reached on the first day of filing. USCIS has once again updated its announcement regarding the number of H-1B petitions received and counted towards the H-1B cap. As of May 4, USCIS has received approximately 45,000 H-1B petitions counting toward the Congressionally-mandated 65,000 cap. As such, USCIS continues to accept petitions subject to the general cap. Additionally, that USCIS has received approximately 20,000 petitions for aliens with advanced degrees remains unchanged. � My wife came here on L2 in Aug-2007 and then applied for EAD
� She has been working on EAD since Aug-2007 with Company A
� Company A applied for her GC on 18-Aug-2009 in EB2 while she was still on L2
� Company A applied for H1 which got approved on 08-Oct-2009 till 01-Oct-2012
� We travelled out of US on 10-Dec-2009 and only gave the L2 I-94 on departure, didn�t give H1 I-94
� She got her L2 stamped from India and entered US on L2 on 03-Jan-2010
Please let us know the following:
� Is there any potential of her H1 getting cancelled because she entered back on L2?
� Do we need to get her H1 stamped immediately by going to Mexico?
� Is her L2 EAD still valid and can she work?

Hi,
I have an interview scheduled for my H1B revalidation stamping at the Mumbai consulate next week. My son will be accompanying me for his H4 stamping.
My wife is already in the US(she travelled using her AP).
The FAQ page of the Chennai consulate says that incase both parents are not accompanying the child for the interview, then the absent parent must submit a signed and notarized 'no objection certificate' to the parent going for the interview. There is no such mention on the Mumbai consulate FAQ page.
Question - Does this apply in my case - since my wife is already in the US ?

Hi,
I am stuck between H1B extn based on 6 yr and GC. My current H1B is expiring on 8th April 2011. I want to file for extn to recover my days outside US (about 60 days). Based on current processing time at Vermont processing center (6 to 8 months), I will not receive approval by end of 6 yr (about June 25th). My PERM was filed on 16-May-2011.
My company says it is not recommended to file for extn beyond 6 hr based on PERM pending if you already have H1 extn approval pending.
What are my options here to extend my stay beyond June 25th?
Appreciate your reply.
