Hello Guys,
I need urgent help regarding my EAD.
I received my EAD after long wait 5 months .... and now it is valid just for 2 months :mad:
where as my I94 is valid till Oct 2011 and so as my husband's.
I called service center and they said that , if I feel there is an error with my card, I will have to send it back and USCIS will correct it if they feel the same and there is no time line for correction..
I need an advice on what should I do - send it for correction or file extension? I already have a job starting soon and I am scared that If I don't get it back in two months I will not be able to take it....
PLEASE HELP...

Dear Attorney,
I am on L1B visa and valid until Oct2010; I somehow decide to apply for green card with certain personal reason.
As I understanding, the employer will file the green card petition for me. I'd like to what's the difference between filing from lawyer ("Duration"), because I am ready to hire a lawyer to file that for myself if it can shorten the duration to obtain a green card. What's the time range it will be processed from L1B to greencard?
My only concern is if it is a shortcut (duration) to file green card petition from lawyer instead of employer.
Looking forward your clarification.

My H1 with Employer A expires Dec 2009 (7th yr). By that time, if my I140 gets approved (with Employer A) I will be eligible for 3 year extensions from there on. Employer A is willing to keep the I-140 current even if I leave them. Now my question is,
* If I change to Employer B's H1 prior to I-140 approval with employer A, am I eligible to apply for 3 yr extension when I am with Employer B?
Can I transfer from Employer B back to Employer A (if my priority date for I-485 becomes current) when I am on the 3yr extension?
The reason I ask is, if my Priority date becomes current and apply for the I-485, I do not want to use my EAD card. I want to be on H1 to be on safe side (incase anything happens to I-485)
Any help is greatly appreciated.

Hi, my BIL was on H1, and lost his job, then he moved on to EAD, which he hadnt because my sister was on h4, then my sister got a job and went to home country to get it stamped as advised by their lawyer. Now her visa got rejected, maybe bec the company she got the job in is not very big. Anyway now for her to come back, my BIL has been advised to go back on H1.
My questions are:
1) How safe is it to go from EAD to H1
2) Is it true that if you are on EAD and then if you try to go back to H1 the chances of it getting rejected are high? And if your H1 gets rejected then there are chances that your EAD will also get rejected?
3) How long does it take to move from EAD to H1
Any insights/suggestions/advises on the above would be greatly appreciated.

We always e-file both AP and EAD even when we dont use them. I recenly filed mine 2 weeks ago. Its easy and fast.

Dear Members,
Recently my husband had received an RFE on I-485 requesting information about his employment verification letter. He had sent all documents back to USCIS and today, I saw an update on my case. The message read that case processing resumed and there will be a decision or update made in 60 days.
Do you know what kind of decision they usually make? Is it normal to have such statements written up for a denial or approval?
Any words of comfort would help. My husband is the primary applicant.

What are the options when labor is being audited?
- Know the reason for audit
- Start a new process and make sure all the reasons from audit are covered under the new process
- When ready to file PERM, withdraw the old application and file a new PERM case
If you are not audited again, you will get the approval in less than 2 months.

The storyline continues. Last year, 13,500 regular H-1B applications were counted in the first week and 5,600 advanced degree applications. This year 5,900 regular applications were received in the first week and 4,500 advanced degree petitions. USCIS just reported that in the second week of counting, 7,100 regular cases were receipted and 5,100 advanced degree applications. Hi, Thanks for the reply, but she did not even know at that point about this provision. This was a kind of typo error, (05 to 04) .
