Hope - USCIS will start disposing faster:
On July 2, 2008, a US Federal District Court in California entered an order requiring that the USCIS pay Mr. Asghar Shirmohamadali, the plaintiff in a Writ of Mandamus (WOM) law suit against the USCIS, around $25,500 in attorney fees and $1,000 in other costs incurred during the suit. In addition, the Court had previously ordered the USCIS to adjudicate Shirmohamadali�s pending I-485 case within 30 days.

Hi,
Currently i am working as full time employee on H1B, receiving W2. I have EAD valid until Oct 2010.
Can i use EAD to work part time and receive 1099 as income statement? If i use EAD / 1099 will this cause an issue for I-485 approval (AOS is pending) ?

Please be aware that W2s at 140 stage are mainly asked to judge the "ability to pay" of the employer. There can be other reasons too.

I recently received an RFE - I 140 and USCIS is asking for all the W-2's from 2004 - till date as i came to U.S.A in November 2004. I got my SSN in Jan ' 2005 and i have all the W-2's from 2005. I am currently unable to understand what to do in this situation. Did anyone had the same problem like me. Please shed your thoughts on this. :confused: :mad:

I got an H1 from an employer with changes of status from L1 effective 31- jan but I will be joining this company only on 4-april-2011. I continued to work for L1 employer till
20-Feb after which i returned to India.
Now i have my visa interview - will i face issues because of the 25 days i spend with L1 employer and that I dont have H1 employer pay stubs?

Guys,
I need to find out what documents I need to send after I file I-765 online. DO anyone has the experience in this matter. I filed my I-485 and at tht time i did not filed my I756 just to avoid lawyer's fee.
The form says I need to send a copy of I-94 and photo thats all, but the confirmation notice I received after filing the form online said that do not send any photo's or any identification document and the notice said that they will sent me a Biometric appointment.
DO anyone has info on this

Here's another article discussing the embarrassment that is CNN's Lou Dobbs Tonight. I don't need to elaborate on that, but the more interesting part of this article is a discussion of why CNN is so reluctant to fire him. The New York Times reports that tomorrow Immigration and Customs Enforcement will be sending instructions to agents in field offices aimed at changing their enforcement focus from work site raids that largely resulted in mass arrests of workers to I-9 audits and undercover investigations mainly targeting employers. However, workers will still be subject to arrest. According to the Times, the guidelines are partly a response to ICE's blindsiding DHS Secretary Napolitano with an unauthorized raid on a Bellingham, Washington mechanic's shop, which I discussed here.

Now that the EB2 dates have moved forward till Dec 2003, how many of us expect our approvals in the coming months ? Would the bulletin move forward in coming months or would go back or may be become unavailable again ? Any thoughts ?
I hope the same forward movement happens for all EB3 applicants too.
How does one now expedite thier case if they are current ? Just by 1-800 .... calling or Infopass ?

I would like to have a list of documents/forms needed to file for derivative I-485 for spouse.
I did come across a few lists on the web, some overlap and some don't, but they do not necessarily address the full list of documents needed when Primary's I-485 is already pending and spouse is filing separately at a later time.
The derivative beneficiary is already in US on a dependent Visa, looking to do AOS instead of CP.
I would appreciate if anyone can provide a list and it'll be great if any members in a similar situation have done it themselves.

My labor/I-140 documents show my salary to be 85K, I am yet to receive my I-140 approval from Nebraska Processing Center, filed in June 2006 under EB-2. Would it cause any problems when I file my I-485 ( priority date March 2004 ) next year if the salary for 2006 is less than 85K ? I was unemployed for two months this year unexpectedly. Thank you for your responses.

My uncle just received his L1 extension receipt. Lawyer was late in filing the L1 extension, but supposedly got everything ready and mailed it 2 days before the L1 expiration date.
However, my uncle received recepit for L1 extension, and received date is 2 weeks after the expiration of original L1. Please note I am talking about RECEIVED DATE (not Notice date or receipt date).
Does this mean extension will automatically get rejected based on late filing? Is there any recourse to this?
More importantly, Is my uncle Out of Status now? (He doesn't have anything else going besides L1)
Please let me know as soon as possible.

As of November 20, 2009, 56,900 H-1B cap subject nonimmigrant visa petitions have been filed with the USCIS. The Service has advised that they will continue to accept petitions until the cap is reached.
Qualifying applicants are still able to petition for an H-1B nonimmigrant visa (http://www.mvplawgroup.com/workvisas.php?action=h1bvisa) under the general cap.
