I and my wife are on h1. I want to come on her h4. She recently applied for h1 extension as her employer is nonprofit org and has some policies of his own, he files every year. She filled in may�09 and got receipt number, as the case is still pending who we can apply for h4 now. Is there any way around to apply for my h4 while the case is still pending?
You can file your H-4 based on the H-1b receipt of your spouse, this is not a problem. They will approve your H-4 for the same duration as your spouses H-1, you will get an approval of H-4 only after your spouses H-1 is approved.

No, you don't. I had a stopover in London on my way back to India. I had a 6 month valid visitor visa of UK and didn't need any transit visa.

Hi,
My 6 yr H1B expires Dec 15,2009. I had applied for labor in 2008 and have received the case number for the labor dated June 26, 2008. My labor is not yet approved and online the status shows "pending". The company has not got any RFE against the labor. I dont know why its taking so much time. My main concern is, Can I apply for h1B extension on the basis of "Pending" Labor approval. What is the time frame to apply for an H1B extension? How long is the extension granted for ? 1 yr or 3 yrs....

I want to know if I am still legal and I am in status? Please let me know the process I should follow if there are any?

I have heard in the past from a lawyer that when in H1B status the filing of Green Card must be done and labor certification approved before the 5th anniversary of H1B status. In other words, one cannot start the process for a Green Card in the 6th year of H1B status.
Is this correct? Or is the lawyer being overly cautious?
If such a rule does exist can you please point me to the exact regulation?

I know that the EAD card comes directly to the applicant and not to the attorney.
What about RFE on EAD? Does that too come directly to the applicant?

One can contiue to stay using I-485 receipt without valid I-94. afasik I-797 can be used only if you filed H1 extention after you came back on parolee.
If a person travels on AP, he will get a new PAROLE I-94 which shows expiry date of 1 year from the day he entered on AP. Can the person stay in US AFTER that expiry date and continue working using a valid I-797?

I just got my labor cleared. EB3.
I need to get the I140 processed
Any idea how much time it generally takes for this to process.
The reason I'm asking is because my h1 needs to be processed in April and if this I140 gets cleared before that, I can get my h1 extension for 3 years.
