Hi there!
I was reading some info abt EAD on this site and have come to know that Once H4 visa holders get their EAD's can work after getting SSN.But I read that If H4 visa holders start working as soon as they got EAD's.Does this invalidate H1 visa status if wife starts working on EAD.Please clarify my doubt.

As it is filed for fiscal year 2008, it should start from Oct 2008.

90 days window period for H1 Stamping before the validity starts.

Hi,
I'm currently on my amlost 6th year of my H1B. I have my i-140 (Still valid) approved from my previous employer under EB3. I'm applying for a new PERM with my current employer and I would want to apply in EB2. I hold 3ys bachelor's degree with 12 yrs of experience. My attorney says that chances are either my PERM or I-140 will be denied based on my education qualification.
I'm looking for your advice on the following.
1) I heard that I can apply for 3yr extn based on my previous I-140. Considering that is it worth the fight on EB2. I'm looking to port my PD (Nov 2008) to this I140 if approved.
2) My company sponsers two PERM to be applied, so it is worth to try for EB2 and later if denied on EB3. Will this affect my H1B extensions? say if it's get rejected on EB2, am I not eligible to apply for H1B extension with my current employer, since my labor/i-140 is denied.
Please help. I'm just not able to get this over my head :(

Guys, I need ur suggestion and experiences on my typical situation
I am in the process of going full time with my client.
I have my I-485 Filed in July 2007 & have EAD & AP
I am not in a position to use EAD as I got married after I filed for I-485. I have to stay on H1B to maintain my wife's H4 status.
my Client's Attorney is filing for H1B transfer and is suggesting that I can use EAD to start working as soon as he files for H1B transfer.
My understanding is I will loose H1 status if I use EAD, hence H4 will be invalid.

I have to file for I-140. Where can I check the status whether it is current or lagging back ? Also is there a Premium 140 for EB2 started or not yet? Since I cannot file for I-485 till it becomes available and current to my PD, does it make sense to file for Premium 140 or should I file regularly?
What are the steps for I-140 and any urls where I can see the status..?

I am on 7th year of H1B with approved 140. 485 not filed yet.
My company is starting layoff and I am afraid I will be hit. If I switch to H4 after being laid off and found a new employer in future, is that possible to switch back to H1B without having to leave the country for a full year?
My current H1B was a three year extension based on approved 140, but I don't know if I will lose the benefit of AC21 and cannot change back to H1B once I switch to H4 since my 6 years have been used up already.
