First, IV truely rocks! Thank you so much guys for all the great work you've done so far!
I've few questions related to I-485 filing:
1. I've single Date-Of-Birth affidavit from both of my parents, will that be an issue? Can USCIS issue me a RFE for not submitting two separate affidavits from each parents?
2. Will it hurt to submit copy of canadian green card having DOB as an additional proof? Also, I'd my fingerprints verified by FBI for canadian immigration, will that speed up my fingerprinting verification for US immigration?
3. I'm only submitting last year 2006 tax return in my 485 filing whereas my lawyers wanted last three IT returns? Will that be a problem?

I applied H1-B for my wife who was not in US at the time of application. The H1-B was applied as an out-of-country option. This would mean that this will not be a change-of-status automatically from H-4 to H1B from 1st Oct as it usually happens. To get into H1-B status, she will have to get it stamped outside of US. It seems her application has been selected in the lottery as we received the receipt notice on May 8th.
My question is - As now she is in US - can I change the processing to say change-of-status from H4 to H1B instead? This would eliminate her going outside the US for stamping. Please respond. Thanks.

Article says "On June 12, 2008, U.S. Citizenship and Immigration Services (USCIS) informed the American Immigration Lawyers Association that the H-1B random selection process has been completed. USCIS completed the intake and receipt processes for all filings as of May 24, 2008 and began mailing rejection notices the week of June 9. Therefore, if an employer has not yet received a filing confirmation (Form I-797C Notice of Action), it likely means that the petition was not selected in the random process and that the rejection notice will be forthcoming."

My husband has 7 words in his name on passport. When we went for Driving licence they took a part of that whole name and issued the licence. But even the last name and first are totally changed now.
How can we change his long name to short by taking only two words from 7. Does it come under Name change case or any other procedure.

In 2007 , I joined a new company and filed my Labour substitution+I140 petition in June 2007. This got approved in November 2007. but my H1B transfer to this company is still not approved. Earlier this year (2008) I went back to my previous company whose H1B is still valid and waited for my old H1B to get approved with no luck.
Now, i wish to start my GC process with this new company, can I retain my old priority date of I140 ? There is absolutely no chance that I will get I-140 approval copy from my old employer, but I have the receipt Number and I know the PD.
Any help is appreciated.

Friends,
I came to USA on H1B on Feb-07. I was working all the time except 6 months. I have pay slips with me and W2 forms. Now I am working on the project but it will be over on 15th of April-09.
I will complete my 3 years. But after this project is over, I don't know I can find the job again.
My question is,is it right time to do the visa transfer? Does it requires very recent pay stub of 3 months? I do not have pay stub for Jan and Feb-09.Does it matters?
What will be my best choice to transfer the visa(but don't know will have job after 15th so does it matters for transfer like client letter) or wait until May-June and file the 3 year extension ? But again that time I will have pay slips until April only.
I am really confused. Please give me your suggestions

Hello everyone,
This question is for my wife. She is currently in her 5th year of H1 which expires in Oct-2011. i.e Her 5th year ends on Oct-2010. She is planning to quit her job now (Aug-2010) due to personal reasons and plans to switch to H4. Her employer (Company-A) has already filed for her GC and her LCA and I-140 is approved, but I believe they will be discontinued once she quits. So here are my questions -
1. Since she will have a little bit over 1 year remaining on her H1, can she file for H1 again if she get a new job offer?
2. Assuming that her next company (Company B), files for a GC within one year, Will there be a problem getting her H1B extended ? Since her new LCA (with Company-B) will be filed less than 365 days before her H1b expires.
3. OR Will USCIS look for the LCA filed by Company-A and grant her H1B extension?

I will be graduating in May'07. I am not eligible for OPT. I have a job offer and the company will be applying for my H1 in April. But I cannot start working before October.

California taxpayers need to cover higher fees of private lawyers, who are hired by the state as the Attorney General's Office doesn't have the staff to handle all of the cases internally. In some instances, the state has employed outside counsel at hourly rates that reach $450 even while most of its in-house lawyers earn less than half that. Rates can be much higher, if the suits require private attorneys having a particular expertise.
Since January 2008, the Department of Corrections and Rehabilitation has signed about $24 million in contracts with private lawyers hired because the Attorney General's Office says it's too shorthanded to take the jobs. The corrections department is seeking the additional help despite having about 80 lawyers of its own to handle a gamut of cases, with about a dozen of those assigned to prisoner-filed litigation.
