Hi,
Currently I am on H1B visa.I will file my 485 as secondary applicant.What are my options in case If I have to leave my job and my 485 is still not approved.
Do I need to file H4 (Since 485 is still not approved) ?

You can status will be Adjustment of Status ( AOS ) but cant work . IYou need a APO if you want to travel . If you want to work you need an EAD .
Check with attorney .This is the essence of mail which i got from my attorney when asked regarding my son status

Hi All,
I have a simple question.
I have my I-140 approved with some kind of receipt number.
My lawyer filed my I-485 and it reached NSC on Aug 9, 2007.
I have not recd. any I-485 receipt notice or number yet.
Can i still track my I-485 progress using my I-140 receipt number on
the USCIS website somehow ?

Hello,
My priority date is October 2007. I got my I-140 denied , based on EB2, on the basis that the 5 years of education does not equate to the 6 years the USCIS believes is required for a Masters degree.
My lawyer got an education evaluation done and filed an appeal withing 30 days , in January 2008. The appeal has been pending since then.
I need advise on what to do next? Should I apply for another I-140? Can I somehow get the appeal decision expedited?

Thanks for your reply. I was off for a month and a half to complete a paper for my Masters and have proof for the same...I was not able to juggle both work and studies....will USCIS consider this excuse to be at home studying without pay?
