    My I-485 application was filed under EB3 category when I was working for my previous employer (PD - October 2006). I changed my job in August 2008, but never sent any documentation for AC21. I now have close to 8 years of experience and also a masters degree (MBA) from a reputed univeristy here in the US.

    Now that EB2 dates are so close to October 2006, is there anyway I can port my application from EB3 to EB2? I can initiate this discussion with my current employer and may be able to convince them to help me. But I want to know exactly what needs to be done.

    Good Morning Folks,

    How about this ? Lets say your consulting firm is ready to file your I-485 upon lots of restriction such as two year agreement and to spend around 10 gran.

    While the big firm who has filed the PERM and waiting for the approval. In this case, can we do both the cases to see which is better upon the current situation.

    This will help few of our folks and your thoughts are always appreciated.

    I'm working on L1 & have H1 petition without COS.

    Can my H1 employer apply for COS, so that I can change my status from L1 to H1 without visiting India?

    Also, I've an offer from a third company... can this company file for Change of Status from L1 to H1 & transfer the H1? I've the H1 petition I129 number, but no paystubs on H1. I've paystubs on L1.

    Can I transfer to H1 to this third company? Will I have to get my H1 stamped frmo INdia then join this third company?

    If not, is there any other option?

    Please reply. Help appreciated.

    I have currently applied for GC under EB3. Got a new job offer in a different state and planning to take up the new job offer. For AC-21, what are the docs/forms required ?
    Do I have to do anything special because I am moving to a different state ?

    I came in on an F1 and got transfered to a H1B without leaving the country.
    My H1 was approved for 3 years ie till 2012.
    Due to problems at my work place, my H1 got revoked by my employer.
    I'm in the medical profession, hence, jobs are few and far between if removed form a training program such as I was in. The next cycle of jobs dont start employment till July 2011.
    I am currently within the 180 day limit.
    What are my options? My countrys consulate is known to be tight fisted with visas, especially as I have overstayed since I lost my job abruptly.
    If my fiance and I do get married, am I eligible for for adjustment of status?

    Please help!

    On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200.     We are applying for my husband's H4 extension now. ( My new H1b extension was approved only till Sept 25, 2009 based on the SOW( client contract) rather than 3 years)So he would be able to get his extention same as me Sept 25, 2009.

    We have also applied for my husband's H1b this year. Hopefully, if his H1b is approved

    1. Does he has to go outside US to get his visa stamped to start working from Oct 1, as there is no status for him from Sept 26 through Sept 30 ( 5 days)

    2. If we apply for his H4 extension along with my H1b extension during early Sept and he will remain in status as the Case will be pending, Does it allow him to start working on H1b without needing to stamp?

    Hi Folks,

    I have a unique situation. Well.. I have been working for a Company A that is owned by my uncle. Iam on H1B in 2nd year and I have my I-140 approved 1 month back. Now I got a new job in another company B with 3 times the current pay of mine. I want to change to the company B.

    My uncle said that he will continuing the process of my GC application, under EB2 in his company A. But I want to transfer my H1B only to the new company B, so I can get into the company B's payroll and get benefits. Can someone suggest how we can handle this without messing up with the current GC process with company A. Does changing to company B under new H1B impacts my GC processing. Can we show that the company A is processing my GC under future employement, though I worked for company A before..

    Please advise the consequences and my options.. I badly want to work for company B..without stopping my GC processing with company A..

    I appreciate your help in advance

    Guys,

    Please help me...I do not have much knowledge about GC process. I am working on H1B visa from last 3 years with my current employer and they are ready to apply for GC but, I know that for GC in the same position I cannot use the experience gained during past 3 years. But if I apply for GC for the next level (as GC is for future employment) with the current experience and keep working in my current role until my GC is approved, do you guys see any problem with that? GC approval will easily take 4-5 years and during this time I can keep working in my current position and once GC is approved I can switch to the next level which is kind of promotion.

    My situation is not very urgent, but I like to stay on top of things. Thanks in advance for your help, it is much appreciated.

    My F1 visa expires on July 6 of 2011. However, I have an I-20 that permits me to stay in the United States until August 31st of 2012. The reason for this is that I came here as a master's student, but transferred to a PhD program. This is my second I-20.

    I have plans to leave for India in May of 2011 and stay until end June 2011. Will it be necessary for me to apply for an F1 Visa extension? Technically I'll be back by July 6, but will it be problematic to get back without a renewed visa because there are only a few days remaining on the old visa? Again, as per the I20 I can stay legally here until August 2012. Is it difficult to renew the F1 visa? All this is almost a year from now but I'm getting quite stressed about the situation. I cannot certainly finish my degree by July 2011.

    I humbly seek any information/advice anyone can provide on this. Thanks again for your time and attention.

    Since H1 is for 6 years, you can extend for another year without filing I-140. You can apply for renewal within 180 days before expiry.

    I NEED HELP from someone who can direct me in this situation

    my h1b expired on june30, 2010 and i filed with the same employer for a new job position related to same profession on june 24 2010. but unfortunately uscis says that they have nothing on their system yet and no receipt of notice by july 20 . my cheques are also not yet cashed. i have fedex receipt proof it being received at uscis center on june 25th 2010. Now what should i do in this situation.

    should i file again with premium processing explaining uscis that my file has been misplaced or has not even processed or filed yet though received on june 25th as per fedex receipt and wait in us till what happens.

    i will really appreciate any help or comments in this situation

    Hi, Last year, I heard about a new rule that says that H4 time will not be counted against H1 time so basically, if someone is transferring from H4 to H1, the time spent in H4 will be excluded while deciding the duration of H1.
    Is this rule true ? I mean, has it become a law now ? Did somebody use this rule to grab the time spent in H4.
    Please let me know.

    Hi ,
    I am going to tgransfer my H1 b with new employer .
    My employer is going for normal processing and I asked him for premium processing as my project is going to end by Aug 2009 . Then My employer informed me that there are lot of RFEs for premium processing . Is it true ?
    Please suggest whether I should go for premium or not ?

    Myself and my wife got first EADs with expiration of Sept 17, 2008. We both applied for renewal on July 14th, 2008 with TSC and my wife got her EAD under a month. My wife is using it work, where as I am still on valid H1b. My application was pending still then, I have called USCIS and put an expedite request on Oct 17, 2008. On Dec 3rd, my case status online updated saying, case transfered to one of the local office. I got a paper notice after 2 days saying:
    for faster processing we have transfered your case to the following location.

    and nothing in the next line, blank.
    Even though I assume this was to faster my process, just wanted to know whether any of you have faced this.
    Appreciate your reply.
