In 2008, all four Oscar winners in the acting categories went to foreign-born persons: Daniel Day-Lewis (Best Actor), Marion Cotillard (Best Actress), Javier Bardem (Best Supporting Actor) and Tilda Swinton (Best Supporting Actress). Of course, these actors were all selected by their colleagues, and what do they know about acting? Hi Immigration Voice Team,
I would like to know your advice,
My details are
- EB3 / Labor filed and approved during July/2007
- I140 & I485 filed concurrently during August/2007
- I140 got approved on Jan/16/2009
- EAD Renewal is made and existing one is valid till Nov/2010
I have only labor number, 140 approval notice with me. where as I do not have labor complete job description.
As of now
- Can I change my employer without any labor job description?
- Does my employer has still rights to revoke I140?
- How can I change job to new employer and protect myself from I140 revoke by existing employer?
- GC filing expenses was completely bared by employer only.

@Kirupa: Not live tiles, but selection tiles (thumbnails) -- square boxes with text and maybe an image . They are use in panoramic applications instead of a list box.
You should do a video tutorial on creating the different elements of a panoramic app, i.e., the listbox, selection tiles (thumbnails), and a listbox with text+image(on the left). I think the xbox hub is a great example.

I received RFE letter from USCIS for missing TB skin test result in the medical reports.I took TB skin test in 2007 and came out negative.Here is the test of RFE
"your application contained form I-693 in which the required TB skin test was not conducted. Please note there may be conflicting information on some published form I-693 instructions regarding when the chest X ray Report should be performed. It is required only when the TB skin test indicates a reaction equal to greater than 5 mm, or when the reason for why the TB skin test is medically inappropriate to perform has been annotated on theform I-693. Please submit a newly completed form I-693 indicating the results of the required skin test."
After consulting the doctor concerned, she filled up new I-693 form with 2007 test results and provide me I-69e form in a sealed envelop. Can you please let me know whether 2007 TB skin test results will be acceptible to USCIS or do I need to do another TB skin test? Please Help.

My six-year H1B expires Feb 2 2010.
My employer (company A) filed PERM with DOL on July 30 2009.
I have spent a total of 2 months outside the U.S while on H1B status.
I have been on bench since July without paystub.
I am leaving the U.S on October 30 2009 and am interested in returning back
through another company
Can I return to the U.S through another employer (company B) on a new H1B visa after Feb 2 2010... How long would that visa be valid for.
If I cannot get a new visa; can I add the total of 5 months spent outside
the US on the current h1b visa for recapture through another employer (company B) after Feb 2 2010 -- return to the U.S; and then
subsequently apply for a 1-year extension after July 31 2010
based on company A's PERM filing.

Hi All ,
I remember last time when PD became current USCIS did not follow the correct order /sequence of PD while allocating visa numbers .
Many of the people who had PD of 2006 got Visa number allocation before people who were in queue ahead of them with 2004/2005 PD.
This time we should have some campaign may be by sending the letter or some way to USCIS/DOS and make them aware to allocate visa based on PD in a fair and transparent way.Any suggestions ????
This opportunity has come after many many years for many of us, we should make our best effort that visa number allocation are done in a fair and transparent way for coming month and month's to come.

I came to US on L1(worked for 1 year) and then switched to F1 till getting my H1B on May 2005 (which is 2 years old). How many years(3 or 4) do I have left on H1? I mean will the 1 year L1 count towards the total six years allocated for H1B?

Once our 140 is approved in the sixth year of H1B, I learnt that we can seek a 3 yr extension. If that's the case, can we change companies during that 3 yr period or are we stuck with the same company that sponsored the 3 yr extension?

I am on H1B visa, and now I am going to fly back to my home country. Unfortunately, I can't find the original left lower portion of my I797, which is "for personal record". I still have the orignial upper portion, I94, and copies of the whole I797 form.
Will I have trouble getting my visa stamp and reenterring this country? What should I do now?

(1) I have applied my Labor Certification in February 2003 and It is approved in September 20, 2007. After almost 4 years. Now, my employer is ready to file I-140 by October 10, 2007. I am also in my 7th year of H1-B visa and it is expiring in August 24, 2008. I have heard that you need to have 365 days of time period between Labor Approval and H1-B renewal of VISA for 8th year. If my I-140 is still in pending stage until August 2008, still Will I be able to get my H1-B extension for 8th year? In reality, I am short of 60 days to finish the count of 365 days.
(2) On the other side, I may not have worry as my Labor was filed in year 2003.
Any Clarifications?

I was wondering how many people really got the opportunity to use the reinstated PPS service for I-140 petition? Has it been useful to the most of people who are stuck in the I-140 backlogs for more than year now or has it only helped a tiny segment of the folks who really needed it to maintain their status?
What is the purpose of USCIS reinstating this PPS if it only helps only very few people. I think its time, USCIS either process the pending applications soon or reinstate PPS for everyone. 1 year is a long time to wait for an I-140 approval when USCIS can re-allocate the staff at quick notice (like those folks who received EADs in two weeks during June 08) if they want to. Its high time USCIS address this issue and get us out of this mess. Visa numbers does not have to be available to process I-140..so there is no reason for them to delay or give excuses.

I am planning to renew my passport. Current passport is going to expire in October 2008.
