    Apart from Deniel notice I also got LUD on I 140.

    Could it be related to old employer revoking I 140?
    Since I have transfered after 180 and did Ac 21 - am I covered.

    Prince - Did you get any LUD on 140 on the day you got this deniel e mail?

    U know what, actually we all eb2 guys are very sad about the eb3 plight. And if we do get a visa number, we will request uscis to dsitribute it to eb3 category. does this make u guys happy now ???

    why dont u think abt those guys, who filed in eb3 earlier, knew that the trouble is brewing, and switched jobs to be able to file under eb2. why you guys dint do that so far. dont blame uscis. they were, the are and they will remain a mystery for ever. its not our birthright. if DOS thinks they need more research grads, they will keep eb1 current, if they need more exp guys, they will improve the b2 category. And if they need more frsh grads, they will come to eb3. And if some exp person is stuck in eb3, he himself is to be blamed. dont blame anyone else for your ignorance of GC rules then.

    So fact is we all are under DOS/USCIS mercy. 2 years back it was eb3 turn, now it is eb2 turn. Unfortunately no is blaming why ebI is always current. if that reason you can digest, then you should have the gall to digest this one too.

    Ok, this thread is degenerating. I had told nothing against EB2 other than saying that we cant be happy for anyone given our situation. We are not asking for any pity, or asking for you to be sad for us. You being (or anyone) sad for us will not make us happy. You "asking USCIS to give us your numbers" will not make us happy either.

    So please stop saying things which is obviously trying to make light of our situation. I see that even though most EB3ers are talking about why the law changed and if it is reasonable for the law to have been reinterpreted, *most* EB2s are responding at a personal level.


    BTW: DoS does not make the determination if they want more or less of Eb1, Eb2, and Eb3s. The law does that. Also note that it wants all 3 categories in equal quantities -- when there is sufficient demand.

    Not really.
    I have flown most domestic airlines in this country on really cheap fares/deals and had good experiences overall.

    My experience with AI was through code sharing with Singapore. And it sucked big time!

    Setting aside my patriotism for a bit, the problem with Air India is it's government run. And we all know how "professional" Indian govt run agencies are.

    I think they came up wit 5K figure just to say F.. off in a gentle way...They never thought that we'll collect 5K and give them. I really think this should be sent out to media and immigration subcommittees, complaining we are paying hefty fees to live in the country on the contrary we are asked for this kind of money to get information which USCIS should have been publishing atleast quarterly...

    EB 3 India has become joke when u look over all the previous patterns. :mad:

    sagar_nyc, agreed. EB3 is a joke and even worst I have become a joker in front of all my friends who applied in EB2 cheating the system. Funny is, experience wise, I am well ahead of all those making fun of me but...:-(

    too bad, eb3 does not even have a place to vent these days as IV forums and its thread only has discussions from EB2 members.

    anyway, best of luck to everybody. the world is not fair, I am willing to fight my part to make it fair and just for all.

    innovation, we are writing to urge your support for three bills that will make necessary incremental
    adjustments to the employment-based (EB) green card system. The measures � H.R. 6039, H.R. 5921
    and H.R. 5882 � enjoy bipartisan support and should be enacted without delay this year.

    America�s scientific and technological leadership is at a crossroads. To remain the world leader in
    innovation, U.S. employers must have access to much-needed and sought-after highly educated talent �
    including scientists, researchers, teachers and medical professionals. Foreign-born professionals make
    great contributions to the U.S. economy and create good, high-paying jobs for all Americans.

    U.S. employers rely on EB green cards to keep foreign-born talent living, working and innovating in
    America. Yet, despite the critical importance of these visas, Congress has failed to address the well
    documented backlogs in the EB green card system that leave some foreign-born, highly educated
    professionals waiting over six to 10 years to receive a permanent resident visa.

    The three bills will address many shortcomings in the EB green card system. For example:

    � H.R. 6039, by exempting highly educated, foreign-born students earning an advanced degree in
    science, technology, engineering or mathematics from a U.S. university from the annual EB green
    card limit, would help U.S. employers retain these talented individuals in the U.S. workforce. For
    example, foreign nationals comprise half of the master�s and 70 percent of the Ph.D.s in electrical
    engineering from U.S. universities.

    � H.R. 5921 will help put an end to multi-year wait times by eliminating unduly restrictive per
    country limits on EB green cards.

    � H.R. 5882 will help to reduce visa backlogs by �recapturing� EB green cards from prior years
    that went unused due to government processing delays and making them available immediately to
    those who meet the requirements.

    Without these incremental reforms, U.S. employers will continue to be crippled in the global competition
    for the world�s best talent, as more and more extremely valuable professionals from around the world
    take their education and abilities to competitors abroad.

    While permanent reforms for the EB green card system will be critical to U.S. employers� long-term
    ability to hire and retain key worldwide talent, H.R. 6039, H.R. 5921 and H.R. 5882 are common sense,
    incremental reforms that should be enacted this year. We again urge your support for these important
    measures.

    Chapter meetups is a positive step. The so called baby step.... If folks RSVP and do not show up, the leaders will get upset if the same folks do not have the courtesy to tell why they did not show up....;)

    First off, I don't appreciate your sarcasm @ 2 cents leading to a dollar. Secondly if your leader is going to scream at people who are not attending the meetings, this is only going to drive people away from IV. Unfortunately, as someone who has learnt it the hard way, using aggressive language (especially language which is a negative judgement on people's nature) does not get the work done at the end of the day.     If you have a good experience with your lawyer and are recommending the law firm, pls also try to talk to your lawyer about IV. Ask the law firm if they want to contribute/ or even publicize IV to their clients. If they agree to do it, please post here. If they refuse, pls post here.

    So when you write about how good your lawyer is, pls also mention if the lawyer supports IV and the help that has been extended to IV.

    This will help maintain a list of lawyers who are recommended by members and at the same time, help IV.

    My advanced parole is good till October 2, 2009. I have been in and out US 2 times, spent 2 months abroad doing finals in college. Am going to intern abroad, until October 28th.

    Q1: What is the best date to reenter the US and renew advanced parole? Do I need to be in the US to renew AP?
    Q2: How long do I need to stay in US after sending in my renewal? Do I need to wait the 3 months to get the new parole?

    I do not think this is the case with OP, given that I quote, Employer X offiered me a job and sponsored my H1B and got it approved too". I guess this is a new H1B filing rather than a transfer from Employer #2 to Employer X. if this is a transfer, OP is in trouble as you suggested and the employment from transfer approval date till now will be considered "unauthorized work".

    could you confirm whether Employer X thing is a transfer or fresh filing?

    There is no such thing called H1B Transfer. You either file an Extension with your existing employer or a New H1B whenever you change an employer. New H1B may or may not come under quota.

    One can have multiple H1B's. In this case, he had multiple H1B for several months butb used only one them. So, he was in H1B status all along with a employer who filed his H1B petition.

    It's not a secret society. I saw them all at DC. May not know the names fully, but have seen them all. No ma'am I never thought they were aliens invading earth :p

    I'm not anti-IV or anti-Core. I appreciate the work being done. I just posted my feelings on the way things work here, with the sincere hope that things can be improved. Definitely not for nitpicking.

    Coming back to my point - you have answered it yourself. I think... I think... Here I think... I don't think..... It's a guessing game for us.

    I'm not asking IV to post every financial transactions over here. It wouldn't hurt to publish summaries - xxx grands spent on yyyy action item. We collected xxxx amount, we need yyyy more.

    Even Know-Nothing organizations like NumbersUSA do that. We know how much they spent last year and how much they're spending this year. There's a reason for it. Lobbying firms need to declare how much money they received from their clients each quarter.

    There's a website called OpenSecrets.org where you can find out how much each organization spent on lobbying, including IV. So the figures are not so secret at all. In fact 'open secrets' after the next quarter.

    Coming back to NumbersUSA, you'll find their views of every frigging piece of legislation in Senate and the House. Where's the IV analysis of STRIVE act? SKIL Bill? NU has a scorecard for every Congressman, what all they did etc. And here we are afraid to talk about what the lawmakers said , as if each one of them will be sponsoring a separate new bill to increase GC numbers for EB immigrants, and it will hurt if anti-immigrants learn of this plan!


    We live in an open society. Each legislation, each ammendment gets posted on Thomas way before it comes up for discussion. NumbersUSA and other anti-immigrant organizations need not look here for what's coming up for discussion. They have their sources in Congressional staff/aides. In fact, most of us learn about upcoming legislations browsing NumbersUSA website, instead of on IV - as it should be! The kind of unneccessarily high secrecy, seen here, is self-defeating.


    Trust is bi-directional. If you don't trust others, they won't trust you. It's easier to participate in things you know and understand, than following things you're instructed to trust blindly[ as in 'I won't tell you anything. I'm doing all I can to help you. You have to trust me on that']. Why do you think 'Know-Nothings' lost to Whigs?

    I got a feeling that some members feel that IV run a secret community with-in IV (I am not sure how many watched the movie "The Stepford Wives" ).

    I think that core members and volunters knows strategy and action plan well before others. I think there would be hierarchy within that also.
    I dont see anything wrong in that.

    Here I think what goes on internally.. If you are more active in the threads you would sure get a message from IV moderators about ur willingness to volunteer. IV core seriously does not have the ability to read the psyches of each individaul member and invite them int to the secret soceity(?). Only possible way to know for them is how much active you are for a while. i dont think there are any specific paramters for that , it is a matter IV core getting convinced that u r serious enough. Not a day or two.. How long .. and how serious you are with ur ideas...

    About funds .. none of the organizations declare their monetory dealings openly. There is a youtube video by logiclife on this. see it if u have not laready seen it.

    Keep up the good work.. Sure you would become the member of secret soceity soon :).

    this is sheer speculation.
    the actual number is likley to be much much smaller based on the few signals we get from our sources. the visa bulletin is issued by DOS NOT USCIS. DOS as we know (remember July 07?) is trying it's best to get USCIS to use EVERY available GC for the year. that is the most important reason for giving them scuh an extended date for RB2 I/C. it appears that they have concluded that udsing the numbers is more important than FIFO.

    whether the overflow goes to EB3 ROW or to EB2 I/C, the fact is EB3 I is going to be the last receipient. i hopw everyone undrestands this. the change in interpretation bu USCIS has not changed the ground facts for EB3 I. ONLY one thing will change those facts- MORE GC NUMBERS, whther by recapture or exemptions or CIR.

    As long as you have had a valid h1b peition approved for employer 1 and employer 2 while you worked for them you are FINE.

    According to my lawyer there is nuthing like a h1b transfer. When someone decides to move to a new sponsor that new sponsor files for a h1b via the petition but nuthing gets transfered, they need to refer to old h1b just to prove thatyou are legal and have been maintaining legal status.

    in your case Employer X did so but you never joined that employer so you are fine. USCIS can get back to that emplyer if they have not cancelled your h1b as they are liable to pay you by law.

    For real as you had an approved petition (latest but not the greatest) from Employer X but did not join them you are fine as long as you were still holding a valid petition with Emp # 2. You should respond back to RFE stating that you were maintaining stauts via emp#2 and were offered a job by EmpX which you never accepted. As a proof you should sen copies of pay stub for enitre period and w-2 + peition and visa copies.
