AGAIN.......
Why people in the forum still asking people to convert from EB-3 to EB-2?
This is not the SOLUTION!! It will only make things worser and worse...
If people keep converting their EB-3 to EB-2 then what about those EB-3 filers that file their application in earlier years? they will keep stucking in the line forever! THAT's not FAIR!
It is not the time to blame EB-2 or USCIS! IT is the time to dicuss an effective way to to distribute the visa no. effectively.
DO SOMETHING CONSTRCUCTIVE! NOT ONLY FOR YOURSELF! BUT FOR ALL THE VISA/ GC APPLICANTS!

I totally understand the push from IV to encourage state chapters and build grassroots strength to this movement.
Join the state chapter : IV does not have a state chapter in the state I live in - Nebraska,: So I thought I would start one and wrote to IV ...after initial response from IV , there has been no progress .
Start contributing: I have already contributed $100 and will contribute further as and when I can.
Volunteer for IV: Volunteered to start the state chapter.
Well I have done my bit so hopefully I will not be disparaged for making comments on this issue,

I am in a silimar situation stuck at PBEC. I haven't posted anything because people are quick to come and bash (as you noted - even if we are just venting frustration - like the rest of everyone a few days back). Yeah, life is unfair but some things further add to it.
P.S. My husband attended the rally in SJ nevertheless (I was out of town.)
We are ready to help BEC guys in whatever way possible.Don't think you are left alone.

Dear All,
All the infigting and ranting we do, only creates a lot of negative energy and negative vibrations. People will continue to do what is right for them and normally try to be in the right side of the law. There is no point discussing about this.
Let us all be clear that within the next year, despite the spillover, both EB2 and EB3 will get absolutley clogged - I expect EB2 and EB3 nos to become more or less equal and clogged. This situation is not going to benefit anyone.
The only possible thing is to try sincerely for some legislative relief, unitedly. Everyone knows that it is like moving a mountain. I spoke to many friends about IV efforts and tried my best sincerely to raise money for advocacy. It was a futile exercise. I felt so sad to realize that everyone I spoke to, was cynical and said that nothing would work out in our favour. Under such circumstances, it is essential that the very few who are committed to work stay united and sincerely try! For most of us with grown up children, this is the only way! Like it or not!
Why cannot all of us atleast make a small contribution for the advocacy? What is the problem?
Again, as a person who is seriously stuck in this mess with children on the verge of completing high school, I have very little options left. Most of the good colleges are NOT willing to consider "aliens" like us eligible for instate (local) tuition. Did anyone think of this? All of us will have to pay international fees! Who can pay $ 50000 per annum? Under the circumstances, please note that many of us will have to return to India or atleast move our families! I wrote a letter to my Senator about this and I got a response saying that he cannot do anything about it. Please think about all the consequences before wasting time on endless EB2 - EB3 fights!
I also want to repeat what I had said a few months back. No immigration system that is not time bound is fair or transparent. With all the sincerity at my command (I have nothing to gain in the process) I would request youngsters in their early and mid 30s to seriously consider options in other "First World" countries which have time bound immigration programmes for highly qualified immigrants. It is an endless wait here.Do you want to spend the next 10+ staring at the visa bulletin very month? . I do not want my junior countrymen to commit the mistake of sinking in this quagmire. With due respect to all the hard work of gurus like Teddy and others, I still feel that it would take about 12 - 15 years for anyone of us waiting beyond Jan 2007 (though I do not wish for it). What would be the state of the economy then? Any thoughts?
High time we stay focused and use this forum in a positive way!

Yes, country of birth should get us close.
needhelp...maybe instead of country of chargeability we should ask for grouping by country of birth; this is an actual field required in the I-485 form.
You are right about priority date. It is not a field available in the 485 form. in the 485 form we reference the approved I-140, which is the only place where your see the "Priority Date" field.

IV is fighting for all EB Categories including H1Bs. When we went to the congressmen and senators this week we never brought up EB2 or EB3 we said all EB is facing backlogs .
As i had said in my previous posts, we all need to rise up to the occation and raise our voice through IV . That is the only solution to all our problems. we need to be united and come forward to attend these events and raise funds .
There are a lot of groups jockying for the Green cards on capitol hill for their interest groups . they are even lobbing for the recaptured visas and quotas etc.. Unless we EB people rise up and make our voices heard, nothing is gong to happen. please come forword and spread the word to your friends to support IV both by participation and financially . even donating 10 dollars a month goes a long way for our cause.
we are 45k Members in IV . But donors are only 10% i heard. that is disappointing paercentage for the high skilled category. Think about it this way . we did not eat one day in a month in a restaurant and instead contributed for a worthy cause which will benifit all of us.
IV has a lot of goodwill among most of the lawmakers. That is because of the sincere efforts putin by the core for advocating our cause. Guys believe me there are a lot of honest people in IV core and IV members who will make efficient use of the financial resources to maximise the bang for the buck. ( I have seen first hand how carefully the money is used during the advocasy days this week in DC ) .
I would also like to point out that Not every time IV will be successfull in blocking an unfavourable amendment or bringing up support for a perticular issue . some times we have to givein to the more stronger groups . thats just how the business is done in DC . it is all based on the deal making in the offices on the hill. we should not be discouraged by the set backs when they happen. We need to be united and fight for our cause.
Hope i have made it clear to all how important is to participate and contribute to IV for our cause.

Unfortunately the sad part is, whatever lobbying is done actually helped only EB2 I, may be due to a wrong notion by USCIS that all Hi-tech immigrants are EB2. This could be a fact as there are thousands of 245 cases that fell into EB3.
Another bad thing was that USCIS release this VB yesterday which means one extra day to CRY.
I do not blame any one, but ourselves. We do not want to spend money and hence dying in this process. No solution, but cry at every VB day.

Hi pd_recapturing, I am glad you understood my post clearly. I understand your point as well. Determining whether a company/employee is indulging in fraud or not is quite difficult if not impossible. I would suggest we start with reporting companies we know people work for and have negative experiences/comments about. It would mean reporting them based on anecdotal evidence but what else do we have as a starting point? I also know website reviews might not be very reliable since some disgruntled employee might post exaggerated comments about a company which might be following all the rules. But in general, we do know from colleagues/friends their experiences about employers who have sketchy credentials. Even TCS, Infosys indulge many times in L1 fraud as I have noticed. All I am asking for is better scrutiny by the USCIS at an earlier stage like PERM so such fraud applications can be removed.
I do not wish the genuine employees any ill will (certainly not) but I would like the fraud ones out of the system. Let's brainstorm more and we might have some success in cleaning out the queue of such frauds. Thanks for your insight.

No one is talking about what happened in Apr-2001. Bill Clinton allowed all illegal aliens to file AOS in EB-3 category. That brought estimated 8-10 million filings in Jan-Apr 2001 under EB-3 category. That's why it took so long for EB-3 to get past Apr-2001. With EB-3 having a number cap, I still have a feeling that those estimated 8-10 million are still floating around in the system and dragging EB-3 category. Any thoughts on this?

So what? Just because they came and skewed the lines doesn't mean you can choose where you're born or when. the rule is unfair wihtout any reason. there is no graceful solution short of removing the quotas. anyway I doubt fairness is the reason you're so fond of this quota.
Here's a one step way to quit.

The visa restrictions, Cap and rules for H1 and H4 all were framed to protect American jobs. If H4 is given work permit then there is a fear that one more job may be taken from the American people. I am not telling it is correct but everyone are in that situation. Also we cannot resolve all the issues. L2 can work H4 cannot work is discrepancy. But one person working in a home will not have any stress especially when there is kid. We have to consider this is an advantage

I applied for my H1-B 3yr extension and am waiting for approval. Right now I dont have a valid 797, all i have is a h1B application receipt, do I just have to include this in the 485 application package instead of the 797? Is this going to be a problem?

I am an EB-3 I and I do agree with lots of Eb-2 folks over here. Eb-3 folks can contemplate of moving on and apply fresh labor/140 and port to Eb2.

the funnies thing is that NSC update for Nov 20 is just found on Immigration.com and no where else .....SO whats the reliability of that document ?
If my attorney is to be believed, USCIS will clarify on Wednesday regarding whether/how to file without receipt notice.
BTW turns out I'm with Nebraska SC too. I had just assumed I would be in TX given that I live in TX! :D
