I currently have an L1 visa, and my H-1B has been approved (with the same employer). The H-1 was applied for as an initial petition. I'm going to get the H-1 stamp on December 18th this year. I'll be coming back to the states then after January 1st.
Are there any issues with a new sponsor filing to a H-1B transfer straight away after I come back? I will have pay slips with my current company, but they will mostly be from when I was on an L-1 visa. Is this an issue with this? Or is there anything else I would need to be concerned with?

The USCIS/DOS set quotas for visa numbers because the United States does not want to be overwhelmed with immigrants. And these quotas are spread evenly through all nations and ethnic backgrounds. Considering the populations of the "oversubscribed" nations, this is justified. I can see where the immigrants from these nations feel "discriminated against" in the fact that they receive a smaller percentage (NOT NUMBER) of visas per capita than ROW countries. This does not make the system unfair. And if you think that certain countries get special treatment, think again; there are plenty of people in ROW (like me) who have been waiting for years as well!
Yeah much of what you said is true, however when you keep harping on the words "equal" and "evenly" You are wrong. Evenly or equally implies each applicant has an equal shot at getting through in a certain period of time. That's my only beef with what you are saying.
Once again however, let me state to you that the intent of US EB immigration law is not to be fair to you or me, it is to do what is best for the employer's skilled labor shortage.(Except in a few self petition cases recognized as in the national interest.)

I am still not clear on what basis you can sue DOL? Is there any law that states that DOL should use FIFO or promises to process the labor within a certain number of days. Don't get me wrong. My case was also stuck in BEC for a long time so I can understand where you are coming from but still there seems to very little chance of winning this lawsuit. In fact it might even be tough to get any lawyer to take up this case.

There is no statutory requirement on wait time. You may not even be an employee when your future employer files for your PERM as green card is for future job.
It's up to your company policies and your "persuasion skills!"
Thanks AskBird, My only concern is if the new EB2 labor or I140 doesn't get approved for some reason, can I fall back to my current EB3 application. I don't want to jeopardize my current application just by deciding to port to EB2. Any suggestions?

My suggestion for you is plan smaller meeting call 5 members in a group and meet at a location explain them and give them the handouts and tell them to meet 5 more people and give you the report. I think this may work.

Good to know you are pursuing a part time MBA. For people stuck inthe GC dilemma, further education is really a good oiption.
For folks around Philadelphia, if you are looking for a good part time programs, Wharton Business school is offering evening programs (Certificate) for Working Professionals. For me it was really a good experience doing the program.

Here is what me and my wife are doing. When the retrogression first hit us in 2005 January we were both devastated even more so because one my friend and his wife, with same the same priority date as ours and similar EB3 RIR got the Green Card on 24 Dec 2004. We would not have been so frustrated if they had the priority date even a month or so before us. But some are just lucky I guess. Coming back to what we are doing. My wife started her masters and finished in May this year. She could have finished in December but we were really banking on the CIR in May so she took more courses and finished it faster. Well that did not happen so whats next. So now I will be starting school again for second Masters this time MBA from one of the top10 B schools in January 2007. Ideally I wanted to do Full Time because its shorter duration as compared to part time but GC God (I wish there was one like that so that I can do the "Nariyal Pooja" or "Mundan" or "Abhishek") had otherr wishes so I have now switched from full time to part time. Lets see if my part time MBA of 4 years wins the race or Green Card wins the racce against time.
Moral of the story. Channelize your energy into something positive and get masters or second for that matter, or learn a new language, enroll in classes to learn languages that run for 6 months at community classees by the time you get your GC you will know atleast a dozen languages.

Just called USCIS and told her that My application was mailed on Jun 28th and it got delivered on July 02. I also told her that my PD is May 2003 (hence i'm eligible to file in June)..
She told me that since i mailed it in June and this Notice goes into effect in July 02 my application WILL NOT be rejected... She asked me to wait for receipt notice :)

Please don't get your hopes up my friend. It's coming back...anything on July 2nd is coming back!

Based on last week's BusinessWeek article, I have a feeling that we will see an effort to restrict initial H1B applications in some way. That would be a good opportunity to push for allowing naturalization applications for people who have been on work visas for a long time (say 8-10 yrs?). Fighting for citizenship would have a stronger emotional dimension and may connect better with the American public. A direct filing for citizenship will work around retrogression by providing an avenue for people to move out of the GC queue.
That would be nice. Citizenship for people who have been on visa and been in the country legally for a number of years. But I doubt it will happen anytime soon.

I am amazed in the solidarity just by seeing the responses. But if i think deeper, this rally is not for some national cause or for some greater benefit.
Every single person here is doing this for one's own SELFISH reasons. Why then are we talking like we are marching to save the planet or save the poor animals going to slaughter or human trafficking or AIDS prevention or even the war in Iraq.
Yes, we make things easy for people down the road (however that is not our true intention, our true intention is just about how to get the card faster) but trying to pull in more people to the rally by playing on people's guilt is not the approach. You say it like you see it. We want people to come so I CAN GET MY GREEN CARD SOONER. Thats all. So everyone has the same motive...thats all. Nothing more or nothing less. Everyone is going for A SELFISH INTEREST...nothing based on higher principles of duty, sacrifice or to ensure higher morals of life. Everything is for sensual enjoyment.
Dont write like we are seeking independence or freedom.
I guess...my head will start to roll...sorry for looking at things differently, I dont mean to find fault but i think this is just one big rally everyone wants to get their green card sooner. Nothing more than that...in my opinion..really not even about folks who may apply in 2010?
Have you seen the hit movie "Wall street" where Michael Douglas says "greed is good". Well this is much like that. We are channeling our ambition into something positive. Positive for us first, but also in other ways. In many ways much of Americas progress/policy is built on events like this.
The bottom line is we are not asking for any special treatment from this country. This is EB immigration. Our employers want us here and have petitioned their government for this. We are simply stating that delays of over 5 yrs in this limbo is not right. We are shining the spotlight on this issue and asking that it not be ignored due to disagreement over what to do with the illegal immigrants.
We are not law breakers, we are not depending on society for our welfare, we are like every right minded hardworking generation before that migrated to this wonderful country for a better life. We are doing things the right way. Most Americans understand that. A few narrow minded, xenophobic, protectionist individuals cannot and perhaps will never understand it, but they will not defeat the immigrant miracle that is America, this has been the case ever since 1492 when Columbus first arrived in the new world.

sagar_nyc, agreed. EB3 is a joke and even worst I have become a joker in front of all my friends who applied in EB2 cheating the system. Funny is, experience wise, I am well ahead of all those making fun of me but...:-(
too bad, eb3 does not even have a place to vent these days as IV forums and its thread only has discussions from EB2 members.

Its a terrible tragedy when lives are lost. My heart goes out to the innocent victims and their family and friends.
Air France is conveniently blaming it on bad weather but I don't buy it...planes fly just fine in bad weather...at least well maintained planes. While their incompetency at customer service clearly shows, they are probably sub standard in maintenance and safety issues as well. Too bad innocent lives have to pay a price to bring that out.
